Introduction
This Policy has been drafted in compliance with the provisions of the Protection of Personal Information Act, 4 of 2013, (POPI Act) as amended, the Regulations, read with Promotion of Access to Information Act, No. 2 of 2000 (PAIA), and the Electronics Communications and Transactions Act, No 25 of 2002.

1 Privacy Policy
1.1. For the purpose of this section Personal
Information (PI) will be understood in
terms of the definition as contained in the
POPI Act and ancillary legislation. At
FUNDA we undertake to ensure optimal
compliance with POPI in respect of the
quality, accuracy, security and
confidentiality of the PI under our custody.

1.2. In this Policy we intend to balance our
legitimate business interests, and the data
subjects reasonable expectation of the
right to privacy. We will therefore take all
reasonable steps to prevent unauthorised
access to, or disclosure of PI.

1.3 In using this website and/or our services,
or your PI is furnished to us a lead
generation services, data subjects may
be asked to provide the following PI.

1.3.1 Emails for communication purposes.

1.4. We will limit the processing of PI to only
that which the data subject consents,
but to the extent necessary, a data
subject’s agreement to this Policy
constitutes consent as contemplated in
section 69 of POPI. Where necessary,
FUNDA will seek to obtain a data
subject’s specific consent should FUNDA
deem same required by law and where
the consent herein might not be lawfully
sufficient.

1.5. FUNDA undertakes not to collect, use or
disclose PI for instance about racial or
ethnicity, political, philosophical or
religious beliefs, trade union
membership, health, biometric or
sexual orientation, except with the data
subject’s specific consent, or in
circumstances permitted by law.

1.6. By agreeing to the terms of this Policy, a
data subject consents to the use of its PI
in relation, but not limited to marketing
and related activities.

1.7. Further, FUNDA commits itself to the
following measures, namely;

1.7.1. installing reasonable technical and
organisational security infrastructure to
protect against accidental or
manipulation, loss, misuse, unauthorised
dissemination, misuse, destruction or
unauthorised disclosure or access to the
PI;

1.7.2. store the PI and place same under a
central database;

1.7.3. the PI will not be stored for longer than
is necessary for the purpose as
described in this Policy or prescribed by
POPI;

1.7.4. the PI collected wild only be by
designated Information Officer/s (IOs)
subject to reasonable confidentiality
obligations.

1.7.5. Appoint the necessary IOs and have
them registered with the Information
Regulator (IR), and periodically provide
them with the necessary training;

1.7.6. ensure that all entities that FUNDA
share PI with are compliant with the POPI
Act;

1.7.7. Constantly update and review all PI and
IT systems;

1.7.8. Constantly monitor all information
contained on any website links on the
FUNDA website to ensure its compliance
with the POPI Act;

1.7.9. Undertakes not to disseminate PI of data
subjects by selling, sharing or renting
any PI to third parties or indulge in
unsolicited emails.

1.7.10 Undertakes to inform the IR and data
subjects forthwith in the event that their
PI has been compromised and advised
what remedial measures have been
activated;

2 Application of ECTA 25 of 2002 (ECTA)
2.1. Data messages as defined in the ECTA
will be deemed to have been received by
FUNDA if and when responded to;

2.2. Data messages sent by FUNDA to a user
will be deemed to have been received by
such user in terms of section 23(b) of the
ECTA;

2.3. Users acknowledge that electronic
signatures, encryption and/or
authentication are not required for valid
electronic communications between
FUNDA and users;

2.4. Information to be provided in terms of
section 42(1) of ECTA;

2.5. Users warrant that data messages sent to
FUNDA from any electronic device, used
by such user from time to time or owned
by such user, we sent and/or authorised
by such user personally.

3 Lodging of Complaints
3.1. All complete should be lodged in writing
at FUNDA with the Information Officer to:

3.2. In the event that an aggrieved data
subject who has lodged a complaint with
FUNDA but remains unsatisfied, he/she
